Size Chart is Inaccurate

I really wanted to love these shoes. I'm a 8-8.5 in American shoe sizes (I do not have wide feet), so I ordered a 39. It was too small so I didn't put them on, but I assumed going a size up would fit. I exchanged it, for an additional price, for a 40. I put them on, and my feet technically fit (though very tight and no socks), but the straps do not fit.

The return policy says they can't be worn, and frankly, I don't want to pay another additional price when the size chart says they should fit. I'm just exasperated. Be careful about ordering these shoes, you may have to order two sizes up.
